These Terms of Service ("Terms") govern your access to and use of HairstyleAI (the "Service"), operated by Bulpara Inc. ("we," "us," or "our"), including our website at hairstyleai.io, our mobile applications for Android and iOS, and our progressive web app.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Description of Service

HairstyleAI is an AI-powered hairstyle preview service. You upload a photo of yourself, select a hairstyle and hair color, and our Service uses artificial intelligence to generate a preview of how that hairstyle might look on you. The Service is available through our website, progressive web app, and native mobile applications. You can try on a hairstyle to see how the Service works.

2. Account Registration

To access certain features of the Service, you may need to create an account using Google Sign-In or Sign in with Apple. By creating an account, you agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Upload photos of other people without their explicit consent.
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Upload content depicting minors.
• Use the Service for any fraudulent or deceptive purpose, including identity theft or impersonation.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools, bots, or scrapers to access the Service without our written permission.
• Interfere with or disrupt the Service or its underlying infrastructure.
• Circumvent any rate limits, usage restrictions, or security measures.
• Use the generated images to mislead others about your actual appearance in contexts where such misrepresentation could cause harm.

We reserve the right to remove any content and suspend or terminate any account that violates these terms, at our sole discretion and without prior notice.

4. AI-Generated Content

The hairstyle previews generated by the Service are produced using artificial intelligence. By using the Service, you acknowledge and agree that:

• Results are approximations: AI-generated previews are illustrative and may not perfectly represent how a hairstyle will look in real life. Variations in lighting, hair texture, face shape, and other factors mean that actual salon results will differ.
• No guarantee of accuracy: We do not guarantee that the generated images will be accurate, realistic, or suitable for any particular purpose.
• Not professional advice: The Service does not constitute professional hairstyling, cosmetic, or medical advice. Always consult with a qualified hairstylist before making significant changes to your hair.
• Your use of results: You may use the generated images for personal, non-commercial purposes such as showing your hairstylist a reference image. You may not use generated images for commercial purposes without our written consent.

6. Intellectual Property

The Service, including its design, features, code, content, trademarks, and logos, is owned by Bulpara Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written consent.

You retain ownership of the photos you upload to the Service. By uploading a photo, you grant us a limited, temporary license to process the image solely for the purpose of generating your hairstyle preview. This license terminates when the generation process is complete and the image is deleted from our servers.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) $100.
• We are not responsible for any decisions you make based on AI-generated hairstyle previews, including but not limited to actual hairstyle changes.

8. Indemnification

You agree to indemnify, defend, and hold harmless Bulpara Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so from your account settings or by contacting us at support@hairstyleai.io.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Delaware.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or an in-app notification. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it will be severed from these Terms. The remaining provisions will continue in full force and effect.
